TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale (hereinafter the "GTC") govern all sales made on the website thecaregel.com by the company THE CARE GEL (hereinafter "the Seller").

1. PURPOSE

The purpose of these GTC is to define the rights and obligations of the parties in connection with the online sale of products offered by THE CARE GEL, including skincare products, manicure accessories, and similar products.

Any order placed on the website implies full and complete acceptance of these GTC.

2. PRODUCTS

The products offered for sale are physical, non-personalized products.

Photographs, visuals, and descriptions are provided for informational purposes only. Slight variations may exist without the Seller being held liable.

In the event of exceptional unavailability of a product after order validation, the customer will be informed as soon as possible and may choose between a refund or an equivalent replacement product.

3. PRICES

Prices are indicated in euros (€), all taxes included (TTC).

Delivery costs are specified before final order validation.

THE CARE GEL reserves the right to modify its prices at any time, it being understood, however, that the applicable price will be that in force at the time of order validation.

4. ORDER

Any order validated on the website constitutes the formation of a distance contract between the customer and the Seller.

An order confirmation is sent by e-mail to the address provided by the customer during the purchase.

The Seller reserves the right to cancel or refuse any order in the event of a previous dispute with the customer or suspicion of fraud.

5. PAYMENT

Payment is made online via the payment methods offered on the website, including:

• PayPal
• Apple Pay

Payment in installments may be offered depending on customer eligibility and the terms displayed during checkout.

International bank charges

Payments made on the website may be processed by a banking institution located outside the European Union.

Depending on the conditions applied by the customer's banking institution, international transaction fees or non-EU payment fees may be charged.

These fees are independent of THE CARE GEL and are solely part of the customer's bank's pricing policy. They remain the sole responsibility of the customer. THE CARE GEL cannot under any circumstances be held responsible for these potential additional fees.

6. DELIVERY

Orders are shipped to the address indicated by the customer during the order.

Delivery methods, serviced areas, and estimated delivery times are specified during the purchase process.

Delivery times are given for informational purposes only. THE CARE GEL cannot be held responsible for delays, losses, or damages attributable to the carrier or external circumstances.

In the event of an error in the address provided by the customer, the Seller cannot be held responsible.

7. RIGHT OF WITHDRAWAL & RETURNS

In accordance with applicable regulations, the customer has a period of 15 days from the receipt of their order to exercise their right of withdrawal.

Returned products must be:

• New
• Unused
• Unopened
• In their original packaging

Return costs are the responsibility of the customer.

After receipt and verification of the returned products, the refund will be made within a maximum of 14 days via the original payment method.

Any opened or used product cannot be refunded for hygiene reasons.

9. LIABILITY

THE CARE GEL cannot be held responsible for indirect, immaterial, or consequential damages resulting from the use of the products sold.

The customer is solely responsible for the proper use of the products in accordance with the instructions provided.

In any event, the Seller's liability shall not exceed the amount of the order concerned.

10. FORCE MAJEURE

THE CARE GEL's liability cannot be engaged in case of non-performance or delay in the performance of its obligations resulting from a force majeure event as defined by applicable law (natural disaster, strike, pandemic, interruption of transport or supply services, etc.).

11. PERSONAL DATA

Personal information collected is used exclusively for order processing and customer relations.

It is never transferred to third parties for commercial purposes.

In accordance with applicable data protection regulations, the customer has the right to access, rectify, and delete their personal data.

12. APPLICABLE LAW AND DISPUTES

These GTC are governed by the law applicable to the company's registered office.

In case of dispute, an amicable solution will be sought first.

Failing an amicable agreement, the competent courts of the Seller's registered office will have sole jurisdiction.
